Laws in our Country are generally in favour of
women. I am not forgetting about the crimes against women, but there are crimes
which are happening against men, that too, from women. Why no one talks about crimes against men?
Women empowerment is essential but it should not be a tool to insult or take
revenge on men.
Women always wanted to be on equal footings
with men. If so, why they are claiming the benefit of the so called laws to
benefit themselves? Both of them have equal right to live. There should
be a mechanism for taking care of the false allegations. Now a days rape cases
are found increasingly reported. Rapists must be treated brutally. But just
think about false rape cases. Who will protect the accused? Women are always
assumed to be truthful in a Court of law!!! If a woman just say that she has been victimized there ends the matter.
Then everything will be decided by “Money”. Men will think that it will be
better to pay whatever they asked for and get out of the hell. Otherwise, the
case runs for years. No one is interested in running behind the cases. Who will
benefit from this? I think it is an issue to think and speak out
loudly.
False rape cases against men
are being filed in many cases. Just read the following details to understand the
volume of threat.
On 6
August 2014, the Chief Minister of Tamil Nadu, Jayalalithaa, during a debate in the
state assembly said that of the 953 cases were registered as rape cases, only
332 cases were found to be actual rape cases. 425 of them were filed after an
affair on mutual consent ended on bad terms and 83 were filed when the man
refused to marry the woman. 53 were cases of molestation which had been
exaggerated.
In October 2014, Delhi Commission of
Women (DCW) released some data, according to which of the 2,753 complaints of
rape filed between April 2013 and July 2014, 1,287 cases were found to be
genuine. The main motivation behind the false cases was found to be revenge to
settle personal scores.
There is a well settled case
decision by Supreme Court in this regard. In May
2013, the Supreme Court of India said that
pre-marital sex on the promise of marriage is cheating or deception, not rape.
The court was appealing of a man had been sentenced by a lower court in Haryana to seven years of
imprisonment. The man had been accused of rape by a woman after he did marry
her after having an affair with her. The verdict had also been upheld by
the Punjab and Haryana High Court. The Supreme Court said that the women 19 years
old at the time of affair was sufficiently mature to understand the
implications of her consent and order the release of the man. The man had
already served 3 years by this time.
There are issues in connection with Dowry
and divorce also. For a better society, women must be protected. Laws must be
there to protect her. But this should not provide an opportunity for women to
use the same as a means to use against men. It is high time that we should
think about the issue. Hence, what I think is, for a better society both men
and women must be protected. Otherwise genuine complaints might be taken care
at par with the false cases. Equality must exist on Laws as well.
